Terms and Conditions

1. Business Identification
N8 Aquatics operates as a sole trader business under Australian Business Number (ABN) 14 677 596 516. These Terms and Conditions govern all sales of livestock and associated goods supplied by N8 Aquatics. By purchasing from N8 Aquatics, the customer acknowledges that they have read, understood, and agreed to be bound by these Terms and Conditions.
2. Nature of Livestock Sales
Aquarium fish are living animals and are subject to biological variability and environmental influences outside the control of the seller once the animal leaves the seller's care. All fish supplied by N8 Aquatics are visually inspected prior to sale and confirmed to be healthy, active, and feeding at the time of packaging or collection. Customers are encouraged to visually inspect livestock prior to departure.
3. Transfer of Responsibility
Upon completion of the sale and once livestock leave the custody of N8 Aquatics, full responsibility for the care, transport, acclimation, and husbandry of the livestock transfers to the purchaser. N8 Aquatics cannot control environmental conditions within the purchaser's aquarium system and therefore cannot guarantee outcomes after collection.
4. Customer Due Diligence
Customers are responsible for ensuring that their aquarium systems are suitable for the species being purchased. This includes but is not limited to appropriate water parameters, tank size, filtration capacity, stocking density, and compatibility with existing livestock.
Fish purchases and husbandry decisions are made solely at the discretion of the customer. While N8 Aquatics may provide general advice regarding husbandry, compatibility, or environmental requirements when asked, N8 Aquatics does not actively assess or verify the conditions of each customer's aquarium prior to sale. Customers are responsible for conducting their own research and ensuring that purchased livestock are compatible with existing fish populations and aquarium environments.
5. Compatibility and Predation
N8 Aquatics accepts no liability for losses caused by aggression, predation, territorial disputes, or incompatible species combinations within the customer's aquarium. Customers must ensure that newly purchased fish are suitable for introduction into their existing aquarium system.
6. Returns and Refund Policy
Due to biosecurity risks and animal welfare considerations, live fish cannot be returned once they have left the possession of N8 Aquatics. Returning livestock to the seller's systems may introduce parasites, pathogens, or contaminants that could compromise the health of other livestock.
Accordingly, refunds, replacements, or credits will not be issued for circumstances including but not limited to:
- Change of mind
- Incompatible tank mates
- Predation or aggression from other fish
- Improper acclimation procedures
- Unsuitable water parameters
- Equipment failures or environmental issues within the customer's aquarium
These policies reflect common practices within the aquarium industry.
7. Order Cancellation Policy
Orders may be cancelled by the customer up to 24 hours before the scheduled pickup time. Cancellations made within 24 hours of pickup may not be eligible for refund if livestock has already been prepared, bagged, or set aside for collection. N8 Aquatics reserves the right to cancel orders in circumstances where livestock becomes unavailable due to health concerns, breeding delays, or other unforeseen circumstances.
8. Goodwill Consideration
While N8 Aquatics cannot guarantee livestock once they have left our care, N8 Aquatics may, at its sole discretion, offer goodwill replacements or assistance in certain circumstances. Such gestures are voluntary and do not constitute an admission of liability or create an ongoing obligation to provide compensation.
9. Transport and Handling
Customers are responsible for transporting livestock safely after collection. Fish should be taken directly to their destination aquarium and should not be left in vehicles or exposed to extreme temperatures or environmental conditions that may cause stress or mortality.
10. Biosecurity and Regulatory Compliance
N8 Aquatics complies with Queensland biosecurity requirements and maintains appropriate husbandry standards for breeding and selling ornamental fish. Customers are responsible for ensuring compliance with any local council regulations, state legislation, or biosecurity requirements that may apply to keeping aquarium fish in their area. Customers should be aware of any restrictions on species ownership or aquarium keeping that may apply in their location.
11. Intellectual Property
All images, breeding information, care guides, and content published by N8 Aquatics on our website or social media platforms remain the intellectual property of N8 Aquatics. Reproduction or commercial use of this content without permission is prohibited.
12. Privacy and Data Collection
Customer information collected during the purchase process is handled in accordance with our Privacy Policy and will be used solely for order processing, communication, and business purposes. N8 Aquatics does not sell or share customer information with third parties except as required to fulfil orders or comply with legal obligations.
13. Force Majeure
N8 Aquatics shall not be held liable for delays or failure to fulfil orders due to circumstances beyond our reasonable control, including but not limited to natural disasters, power outages, disease outbreaks affecting breeding stock, extreme weather events, equipment failures, or other unforeseen events that impact our ability to maintain or supply livestock.
14. Limitation of Liability
To the maximum extent permitted by law, N8 Aquatics shall not be liable for any direct, indirect, incidental, or consequential losses arising from the purchase, transport, introduction, or keeping of livestock once they have left our care. Livestock outcomes depend heavily on environmental factors outside the control of the seller.
15. Dispute Resolution
In the event of a dispute arising from the purchase of livestock or services from N8 Aquatics, the parties agree to first attempt to resolve the matter through good faith negotiation. If the dispute cannot be resolved informally, the parties may pursue mediation before initiating legal proceedings. Any legal proceedings shall be subject to the jurisdiction of the courts of Queensland, Australia.
16. Australian Consumer Law
Nothing within these Terms and Conditions excludes or restricts rights provided under the Australian Consumer Law. Customers retain statutory rights where goods are not as described or are not of acceptable quality at the time of sale.
17. Acceptance of Terms
By purchasing livestock from N8 Aquatics, customers acknowledge that they understand the nature of live animal purchases and accept these Terms and Conditions in full.
